General Terms and Conditions of Prismart Constructions

1. Definitions

Seller: Prismart Constructies, located at Diadeemstraat 107 , 1336 TT Almere, The Netherlands .
Buyer: the natural person or legal entity who enters into an agreement with the Seller.
Products: all goods offered by the Seller via the webshop, including discount parts.

2. Applicability

These general terms and conditions apply to every offer made by the Seller and to every agreement concluded between the Seller and the Buyer.

3. Offer and Agreement

Each offer contains such information that it is clear to the Buyer what rights and obligations are associated with accepting the offer.
An agreement is concluded at the moment that an order has been confirmed by the Buyer and accepted by the Seller.

4. Prices and Payments

All prices include VAT and other government levies.
Payment must be made using the payment methods offered in the webshop.

5. Delivery and Delivery Times

The Seller will exercise the utmost care when receiving and executing orders for products.
The place of delivery is the address that the Buyer has made known to the company.

6. Retention of title

The delivered products remain the property of the Seller until all payments have been made in full.

7. Right of withdrawal and returns

The buyer has the right to cancel the agreement without giving any reason within [number] days after receipt of the product.

8. Warranty and Conformity

The Seller guarantees that the products comply with the agreement, the specifications stated in the offer, and the reasonable requirements of soundness and/or usability.

9. Liability

The Seller is not liable for damage resulting from incorrect use of the products or use against the instructions.

10. Force Majeure

In the event of force majeure, the Seller is not obliged to fulfil its obligations towards the Buyer.

11. Intellectual Property

All intellectual property rights relating to the webshop, including software, texts, images and sounds, belong to the Seller.

12. Complaints procedure

Complaints regarding the performance of the agreement must be submitted to the Seller within 30 days of discovery, fully and clearly described.

13. Applicable Law and Competent Court

Dutch law applies to any agreement between the Seller and the Buyer.

14. Changes to the Terms

The Seller reserves the right to change these general terms and conditions.
